Donor's Rights in New Jersey
In New Jersey, as in most other states, if a person becomes eligible to be a donor upon his passing and has designated his wishes to be a donor through his driver's license, ID card, donor card, registry, or living will, those wishes will be followed. In the past, families or medical proxies had the ability to override the donor's decision. Under the current law, when a person has documented his decision to donate, and is in the position to donate, those wishes will be shared with the family and donation will proceed. In the absence of any donor indication, the decision will be left to those authorized by law to make the decision, such as close family members. When you make the donor designation, it's always a good idea to share that decision with your family and let them know why it's important to you. Designating your wishes ahead of time helps relieve families of the burden of making that decision for you at such a difficult time.
